WAIVER - Layla’s Little Neighborhood LLC

DEFINITIONS:

You or Your: The person whose signature appears on this document.

Participant(s): Any person on whose behalf You are signing this document.

Layla’s Little Neighborhood LLC: Any of its owners, management, employees, representatives, volunteers, affiliates, associates, sponsoring agencies, members or participants to Layla’s Little Neighborhood LLC. 

THIS IS A BINDING AGREEMENT IN WHICH YOU SHOULD READ CAREFULLY BEFORE SIGNING. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN RIGHTS, INCLUDING THE RIGHT TO BRING A LAWSUIT TO RECOVER DAMAGES IF YOU OR THE PARTICIPANT(s) ARE INJURED WHILE PARTICIPATING IN ANY ACTIVITY AT LAYLA’S LITTLE NEIGHBORHOOD LLC YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM AND RELEASED PARTIES HAVE THE RIGHT TO REFUSE TO ALLOW YOU, YOUR CHILD AND OTHER PARTIES PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

You acknowledge that You are the parent or legal guardian of the Participant(s) named on this form, and/or You have obtained permission from the parent/legal guardian of the Participant(s) named on this form to sign and execute the agreement on their behalf after discussing the terms of this Agreement with the Participant’s(s) parent or legal guardian.

ACKNOWLEDGMENT AND ASSUMPTION OF RISK  - You understand that there are inherent risks associated with participation in Layla’s Little Neighborhood’s, related activities, programs, events, and parties. These include but are not limited to, the use of any Layla’s Little Neighborhood’s, toys, equipment, materials, exhibits, facility decor, furniture, and/or facility. 

ASSUMPTION OF INJURY - You understand and voluntarily accept on behalf of the Participant(s) that risks of injury can occur, whether caused by the Participant(s) or another person, at Layla’s Little Neighborhood LLC.

You understand that activities within the facility involve risk of injuring, including serious and/or permanent physical injuries and death which might result not only from our own actions, inactions, or negligence, but also the actions, inactions, or negligence of others, including Layla’s Little Neighborhood LLC, its owners, management, employees, representatives, volunteers, affiliates, associates, sponsoring agencies, members or participants, the environmental conditions or the equipment used.

You knowingly and freely assume all such risks, both known and unknown, including those that may arise out of the negligence of participants: owners, management, employees, representatives, volunteers, affiliates, associates, sponsoring agencies, members or participants, and own.

PERSONAL PROPERTY - You agree to assume all risk of losses, damage, or theft of personal property for yourself and the Participant(s) while present or participating in any of Layla’s Little Neighborhood LLC, related activities.

SURVEILLANCE VIDEO AND MEDIA/PHOTO - You understand that video security cameras are positioned in appropriate places within the premises of Layla’s Little Neighborhood LLC. To ensure the safety of employees and participants, as well as the security of our facility, we may conduct video surveillance on our premises at any time, with the only exception of private areas (i.e. restrooms, assigned breastfeeding areas, etc.). 

You grant permission to Layla’s Little Neighborhood LLC, and its owners, management, employees, representatives, volunteers, affiliates, associates, instructors the unrestricted right to reproduce or take photographs and/or video images taken of You and/or, Participant(s), and/or your family members, for the purpose of publication, website, promotion, social media, illustration, advertising, trade, print media, and marketing advertisements in any manner or in any medium. 

In addition, You waive the right to inspect or approve any finished media or photo products taken of You and/or, Participant(s), and/or your family members. And, You waive the right to any royalties or other compensation to any arising or related use of photographs, video, or other physical or digitally recorded media taken at Layla’s Little Neighborhood LLC.

RELEASE OF LIABILITY - You, yourself, the Participant(s) named on this form, and your respective heirs, assigns, administrators, personal representatives, and next of kin, hereby release and hold harmless, and waive the right to take any action to any claims, injuries, loss, theft, or damages liabilities that arise, and/or related to negligence of Layla’s Little Neighborhood LLC, facility or our participation in any and all Layla’s Little Neighborhood LLC, activities, parties, cafe lounge and the use of the play area.

You waive any and all liability, claims, suits, demands, causes of action, expenses of litigation, including but not limited to, attorneys fees and costs against, Layla’s Little Neighborhood LLC, and/or its owners, management, their affiliates, officers, members, agents, employees, other participants, and sponsoring agencies arising out of any kind of injury claims, loss, theft, or damages liabilities to Yourself and Participant(s). Should Layla’s Little Neighborhood LLC be required to incur attorney’s fees and costs to enforce this agreement, You agree to reimburse them for all such fees and costs.   

You understand that You are responsible for the Participant’s(s) safety and behavior; and that they will remain in your view at all times of the visit. You will closely monitor the Participant(s) as there are potential choking hazards.

You understand that in order to enter the facility, You and the Participant(s) must be well and free of any communicable/ contagious illnesses. 

NOTE: We reserve the right to deny service to anyone who may appear ill, and we reserve the right to ask anyone who does not adhere to this signed agreement to leave without a refund. 

THIS IS A RELEASE OF LIABILITY,

DO NOT SIGN IT UNLESS YOU AGREE TO BE BOUND BY ITS TERMS

You hereby certify that You have read and understood this document and agree to accept ALL terms and conditions.
